1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the HighEndFree website, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Independent Platform Disclaimer
HighEndFree is an independent platform. HighEndFree is not affiliated with, endorsed by, sponsored by, or officially connected with Amazon or any other third-party marketplace, retailer, or platform. We are not affiliated with Amazon.
All third-party names, trademarks, logos, and marketplaces belong to their respective owners. Reference to any third party does not imply partnership or endorsement.
Users and sellers are responsible for understanding and complying with any rules, policies, and requirements that apply to them on third-party marketplaces or platforms (including, without limitation, Amazon and similar sites).
We do not guarantee that any third-party marketplace will allow, approve, publish, or keep any review or other content you submit elsewhere.
3. Eligibility
You must be of legal age to enter a binding contract in your jurisdiction to use the Services. If you are not, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
We may refuse service, close accounts, or limit access to anyone at any time, including where we reasonably believe there is a legal, fraud, or policy concern.
4. Accounts
You must provide accurate, current account information and keep it updated. You are responsible for safeguarding your credentials and for activity under your account.
You may not create fake accounts, duplicate accounts to evade enforcement, or impersonate any person or entity.
We may suspend or terminate accounts for fraud, abuse, violations of these Terms, suspicious activity, or harm to the Services or other users.
5. Seller Accounts and Product Listings
Sellers are responsible for the accuracy of product listings, including descriptions, pricing, refund or discount representations, categories, images, and any stated limits or conditions.
Sellers may not list illegal, unsafe, counterfeit, restricted, misleading, or prohibited products, or products that violate applicable law or our policies.
Sellers are responsible for fulfilling obligations they communicate to buyers and for complying with applicable laws.
We may review, edit, reject, pause, or remove listings or seller content for any reason, including legal compliance, fraud prevention, accuracy, or policy enforcement.
6. Product Requests
Users may request products through the platform subject to these Terms and our policies. Product availability, seller approval, fulfillment, refunds, reimbursements, and timing are not guaranteed unless we clearly confirm otherwise in writing for a specific request.
We may limit, reject, cancel, delay, or review requests for fraud prevention, abuse prevention, capacity, or compliance reasons.
7. Reviews and User Content
Reviews and other content you submit must be honest, truthful, and based on your real experience with the product or service you are reviewing, where applicable.
We do not require positive reviews. You must never be required—by us or by a seller—to leave a positive review, a five-star review, or any particular rating.
You may not submit fake, misleading, copied, or dishonest reviews, including reviews that misrepresent your experience.
You may not submit reviews for products you did not actually receive or use in a genuine way intended by the platform, or use AI or other means to fabricate a false experience.
Users must not be pressured to change, remove, or withhold a review. Sellers and users may not coerce, threaten, or harass others over reviews.
We do not control third-party marketplace review systems. Reviews posted on other platforms remain subject to those platforms’ rules and enforcement.
8. Incentives, Refunds, and Disclosures
If you receive a free or discounted product, refund, reimbursement, or other benefit in connection with a listing or request, that may create a material connection that must be disclosed clearly and conspicuously where required by law or by the policies of the platform where you post content (for example, a marketplace’s community guidelines).
Any material connection must be disclosed where required. You are responsible for understanding and following applicable disclosure obligations. We do not tell you to hide incentives or material connections.
Sellers are prohibited from requiring a positive review (or a specific star rating) as a condition of providing a refund, discount, reimbursement, or other benefit.
Refunds, reimbursements, product availability, and approvals are not guaranteed by HighEndFree unless we explicitly state otherwise in writing for a particular transaction.
We prohibit fake, misleading, coerced, or undisclosed incentivized reviews to the extent described in these Terms and our separate disclosure materials.
9. Prohibited Conduct
In addition to other restrictions in these Terms, you may not:
- Create, solicit, buy, sell, or exchange fake or misleading reviews, or engage in review manipulation
- Offer or accept undisclosed incentives for reviews where disclosure is required
- Threaten, coerce, or harass users over reviews, or force or solicit positive reviews
- Ask users to remove or alter negative reviews in exchange for benefits
- Use duplicate accounts, fake identities, or impersonation
- Commit fraud, abuse chargebacks, or misuse payment systems
- Scrape, crawl, or overload the Services; interfere with security or operation
- Violate applicable laws or third-party marketplace rules you are subject to
- Use the Services to facilitate conduct that violates Amazon, marketplace, or platform policies
10. Refunds and Payments
Membership or subscription fees, if offered, are processed through our payment provider (for example, Stripe). Fees, renewals, cancellations, and plan changes are described at checkout and in account settings where applicable. You authorize us and our payment partners to charge your payment method in accordance with the plan you select.
Product-level refunds or reimbursements depend on the specific terms communicated by the seller and any applicable agreement for that request. The platform does not guarantee such refunds or reimbursements unless explicitly stated in writing for that request.
You must provide accurate refund contact information (such as PayPal or other methods we require) if needed to operate refund or support workflows.
11. Enforcement
We may investigate conduct that we believe violates these Terms or poses risk to users or the Services.
We may suspend, restrict, or terminate accounts; remove or restrict listings or content; cancel or hold requests; and cooperate with law enforcement or regulators where we believe it is appropriate.
We may suspend users or sellers who use the Services for review manipulation, fraud, abuse, or policy violations.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted service, error-free operation, product availability, seller performance, specific approvals, publication of reviews on third-party sites, income, or any particular marketplace outcome.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIGHENDFREE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.
WE ARE NOT LIABLE FOR THIRD-PARTY MARKETPLACE ACTIONS, ACCOUNT SUSPENSIONS ON OTHER PLATFORMS, OR ENFORCEMENT BY THIRD PARTIES, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HighEndFree and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: your use of the Services; your listings or requests; your reviews or other content; your violation of these Terms or law; review manipulation or false statements attributable to you; or your violation of third-party rights or marketplace policies.
15. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on the Services and update the “Last updated” date where practicable. Continued use after changes become effective constitutes your acceptance of the revised Terms, except where applicable law requires additional consent.
